Case Overview:
A 54-year-old woman fell off a ladder and went to the emergency room. She was discharged and claims she was not made aware that she had a tibial plateau depressed fracture at that time. Three days later, her primary care physician made her aware of the fracture. She subsequently had surgery. The defense showed that the tibial plateau fracture did not worsen over the course of the 3 days and did not change the course of her overall treatment. The jury found in favor of the defense.
